Bush Signs "Can-SPAM
Act" – What You Should Know
Tuesday, December 16th, President Bush signed the anti-spam
legislation, called
"Can-SPAM Act" –
"Controlling the Assault of Non-Solicited Pornography
and Marketing Act." This legislation makes it illegal
for those e-mailers who send millions of messages each day
selling their product. This law is intended to stop spammers.
Legitimate permission based e-mailers are not affected.
Welch Integrated,
Inc. leads the way in appropriate email marketing and
has for over the past six years. We work in compliance with
the new laws and will help you determine if your lists comply
with the new restrictions. Don't go with the wrong online
marketing company and suffer costly fees for not following
the new legislation. The highest penalties include multi-million
dollar fines and jail terms for violators.
The laws vary from state-to-state. The state with the strictest
laws is California; they now require permission from consumers
before a company can send them any commercial emails.
No Changes Needed Here – Welch Integrated Already
In-Sync With The New Laws
Welch Integrated
has used and continues to use permission
based email marketing. To put it simply this means that
we do not send e-mails to consumers who haven't signed up
to receive e-mail notices. Our system is not even affected
by the new laws; we were already using the legal and non-intrusive
ways of gathering email lists. We also use cutting-edge techniques
to increase list size, targeting customers that are interested
in your business. An added feature that we have is our Global
Remove List, which enables us to remove unsubscribers from
your list.
Under the new legislation, marketers can still send messages
to any email address as long as they clearly identify themselves
and give consumers a means to "opt-out" of future
e-mail campaigns. The best and most effective way to ensure
that you follow the new laws is to evaluate if you have a
preexisting business relationship and/or consent from your
subscribers.
Preexisting business relationship - The
recipient of your email has made contact with you: made a
purchase, responded to an email or had offline contact with
you.
Consent - The recipient of your email has
been fully notified and agreed to the collection and use of
their email address.
Time Spent on Junk Mail - Decreased!
Time Spent on Your E-mails - Increased!
Welch Integrated
knows this legislation is good news for our current and potential
customers. The amount of time people spend dealing with junk
mail will dramatically decrease therefore increasing the amount
of time consumers have to spend reading your email notifications,
surveys or newsletters.
Summary
1. E-mail messages need to be labeled (content of message
identified).
2. Include opt-out instructions and the sender's physical
address.
3. Prohibits use of deceptive subject lines and false headers
in messages.
"Spam, or unsolicited e-mails, are annoying
to consumers and costly to our economy."
- White House Spokesman, Scott McClellan said after Bush signed
the Anti-Spam act.
